Terms of Service

1. Acceptance of Terms
By accessing or using the FamJet website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
FamJet LLC ("FamJet," "we," "us," or "our") reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.
1.1 Modifications to Service
We reserve the right to modify, update, suspend, or discontinue any aspect of the Service at any time, with or without notice. This includes but is not limited to:
- Adding, removing, or changing features and functionality
- Modifying pricing or service offerings
- Updating our recommendation algorithms and methodologies
- Changing the format or delivery method of packing lists
We are not obligated to maintain or support any particular features or functionality. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
2. Description of Service
FamJet provides personalized family packing list recommendations based on trip details, destination, and family member information you provide. Our Service includes:
- Custom packing list generation tailored to your trip type, destination, and family composition
- Age-specific recommendations for family members
- Destination-aware suggestions based on climate, activities, and local considerations
- Online packing list accessible via secure link delivered by email
Packing lists are provided as recommendations only. FamJet does not guarantee that our recommendations will be complete or suitable for every situation. You are ultimately responsible for determining what items to pack for your trip.
2.1 Service Availability
While we strive to provide reliable and uninterrupted service, we do not guarantee that the Service will be available at all times or that it will be error-free. The Service may be temporarily unavailable due to:
- Scheduled or emergency maintenance
- Technical difficulties or system failures
- Issues with third-party service providers
- Internet or network connectivity problems
- Security incidents or attacks
We reserve the right to suspend or restrict access to the Service at any time for maintenance, security, or other operational reasons. We will make reasonable efforts to provide advance notice of scheduled maintenance when possible, but are not obligated to do so.
We are not liable for any loss, damage, or inconvenience caused by service interruptions, delays, or unavailability of the Service.
3. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. Orders and Payment
When you place an order through FamJet, you agree to provide accurate and complete information about your trip and family members. Payment is processed securely through Stripe, our third-party payment processor.
By completing a purchase, you authorize us to charge the payment method you provide for the total amount of your order. All prices are in US dollars unless otherwise stated.
4.1 Third-Party Services
Our Service integrates with and depends on various third-party service providers, including but not limited to:
- Stripe: Payment processing and transaction management
- Brevo: Email delivery and communications
- Meta (Facebook): Analytics and advertising (for non-GDPR regions)
By using our Service, you acknowledge and agree that:
- These third-party services are governed by their own terms of service and privacy policies
- We are not responsible for the performance, availability, or security of third-party services
- Service functionality may be limited or unavailable if third-party services experience issues
- We may change, add, or remove third-party service providers at our discretion
We are not liable for any damages, losses, or issues arising from the use of third-party services, including but not limited to payment processing failures, email delivery problems, or data breaches at third-party providers.
5. Satisfaction Guarantee and Revisions
FamJet offers a 100% satisfaction guarantee. If you are not satisfied with your packing list, we will work with you to make it right.
Revision Policy:
- You may request up to three (3) revisions to your packing list within 30 days of delivery
- Revision requests should be submitted via email to info@famjet.com
- We will process revision requests within 48 hours
Refund Policy: Due to the digital nature of our product, we do not offer monetary refunds once a packing list has been delivered. However, if you are genuinely unsatisfied after utilizing your revision requests, please contact us and we will review your case individually.
6. Intellectual Property
6.1 FamJet Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, algorithms, artificial intelligence models, machine learning systems, recommendation engines, and proprietary methodologies, are the exclusive property of FamJet LLC and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
Our Service uses and will continue to develop proprietary algorithms, including artificial intelligence and machine learning technologies, to generate personalized packing recommendations. These algorithms, methodologies, and the underlying recommendation system constitute valuable trade secrets and proprietary technology of FamJet LLC.
6.2 License to You
Upon purchase, you are granted a personal, non-exclusive, non-transferable, revocable license to use your packing list for personal, non-commercial purposes only. You may not:
- Reproduce, distribute, or sell our packing lists for commercial purposes
- Share packing lists with individuals outside your traveling party
- Publicly post or redistribute packing lists on websites, social media, or other platforms
- Reverse engineer, decompile, or attempt to derive the algorithms or methodologies used in our Service
- Create derivative works based on our packing lists or recommendation system
- Remove or alter any proprietary notices or labels
6.3 AI-Generated Recommendations and User Responsibility
Important Notice: FamJet uses artificial intelligence, machine learning algorithms, and automated systems to generate packing recommendations. While we strive for accuracy and comprehensiveness, these recommendations are provided as suggestions only.
You are solely responsible for:
- Reviewing and verifying all packing recommendations before your trip
- Determining the suitability and completeness of recommendations for your specific needs
- Ensuring you have packed all essential items, including but not limited to travel documents, medications, and safety equipment
- Adapting recommendations based on your personal circumstances, health requirements, and destination-specific regulations
AI-generated recommendations may not account for all possible scenarios, personal preferences, medical needs, or last-minute changes in travel conditions. Always use your own judgment and consult relevant experts (medical professionals, travel advisors, etc.) as needed.
6.4 User Data
You retain ownership of the personal information and trip details you provide to FamJet. By using our Service, you grant FamJet a worldwide, non-exclusive, royalty-free license to use, process, and analyze your data solely for the purposes of providing and improving the Service, including training and refining our AI algorithms and recommendation systems.
When we use your data to improve our Service and train our AI models, we aggregate and anonymize the data so that it cannot be traced back to you individually. This anonymized data helps us understand patterns (such as common items needed for beach trips with toddlers) without identifying specific users.
We do not sell, rent, or trade your personal information to third parties. Your data is used exclusively to provide our Service to you and to improve our recommendations for all users.
7. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Submit false, misleading, or fraudulent information
- Attempt to gain unauthorized access to our systems or networks
- Interfere with or disrupt the Service or servers
- Use automated systems or software to extract data from the Service
- Resell or redistribute packing lists without our written consent
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
FamJet does not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- The packing recommendations will be complete, accurate, or suitable for your particular trip
- Any errors in the Service will be corrected
Packing lists are suggestions based on the information you provide. You are solely responsible for verifying that you have packed all necessary items for your trip, including but not limited to travel documents, medications, and essential personal items.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FAMJET LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Force Majeure
FamJet shall not be liable for any failure or delay in performing our obligations under these Terms when such failure or delay is due to circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, extreme weather events, earthquakes, floods, or fires
- War, terrorism, civil unrest, riots, or acts of government or military authority
- Pandemics, epidemics, or public health emergencies
- Labor disputes, strikes, or lockouts
- Interruption or failure of telecommunications, internet infrastructure, or utility services
- Cyber attacks, hacking attempts, denial of service attacks, or other security incidents
- Failure or unavailability of third-party service providers essential to our operations
- Government regulations, sanctions, embargoes, or legal restrictions
In the event of a force majeure occurrence, our obligations under these Terms will be suspended for the duration of such event. We will make reasonable efforts to mitigate the effects and resume normal operations as quickly as possible.
If a force majeure event continues for more than thirty (30) days, either party may terminate the affected service without liability.
11. Indemnification
You agree to indemnify, defend, and hold harmless FamJet LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.
12. Termination
We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Washington State.
13.1 International Use and Export Compliance
The Service is controlled and operated from the United States. We make no representations that the Service is appropriate or available for use in other locations. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
You agree to comply with all applicable U.S. export control laws and regulations, including but not limited to the Export Administration Regulations (EAR) and sanctions programs administered by the Office of Foreign Assets Control (OFAC). You represent and warrant that:
- You are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to U.S. sanctions or embargoes
- You are not listed on any U.S. government list of prohibited or restricted parties
- You will not use the Service in violation of any export restrictions, laws, or regulations
We reserve the right to refuse service or terminate accounts of users in sanctioned countries or on restricted party lists.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FamJet LLC regarding your use of the Service and supersede all prior agreements and understandings.
